A San Juan County District Court judge has granted the owners of Cole Ranch subdivision a quiet title order, declaring them the owners of the old Silverton Northern Railroad grade across their property near Eureka.
But the order leaves in place provisions of the subdivision’s county-approved plat, which prohibits the owner from excavating or altering the grade or building a structure within 25 feet of the centerline of the grade.
The Feb. 15 order by San Juan County District Judge Gregory Lyman ends a long-running dispute between the property owners — Merlin Schaefer, Sandra Ippolite and San Juan Mountain Properties LLC, and San Juan County over the ownership of the historic railroad grade.
