County officials face new lawsuit over old railroad grade

The San Juan County Board Chairman Ernie Kuhlman signed two letters Wednesday, March 9, declaring the county has no ownership of the abandoned Silverton Northern railroad grade across property owned by Joe Jepson and Jack Clark in the upper Animas River valley.
But minutes later the commissioners were served with papers notifying them that another property owner, Merlin Schaefer, had filed a lawsuit against them on Tuesday seeking damages for the county’s protracted arguments that the county has a claim to the railroad across the Cole Ranch subdivision.
The three commissioners — Kuhlman, Pete McKay and Terry Rhoades — were among seven current and former county officials listed as defendants in the lawsuit filed in San Juan County District Court.
